Capt Watts and Mr Aisquith bring from the House the
following Message

By the House of Delegates Sept 8th 1704

The Committee for Elections and Privileges enters the
house and reports that upon reading the within Indenture
appeared all four Delegates therein appointed are duly and
legally Elected but the Sheriff of Somersett County has not
made any due and legal Return thereof as by Law he ought
to do.

Which the Committee offers to the House for their Consid-
eration

Upon reading the above Report of the Committee the
House Concur therewith that the members are duly Elected
and that the Sheriff has not done his Duty, that his failure is
not wilful or prejudicial to the publick but only in a deficiency
in not returning Separate Indentures for each Person there-
fore he is not lyable to the Penalty of the Act of Assembly,
but however we pray he may be summoned to answer the
neglect before his Excellcy and Council &c.

Whereupon the following answer was sent to the House

By his Excy the Governour and Council

The Houses Message relating to the omission or mistake
of the Sheriff of Somersett County on the return of the Writt
of Election was received at this Board and the said Sheriff
will be cautioned of the like for the future

The honble Thomas Tench Esqr John Addison Esqr Thomas
Brook Esq Robert Smith Esqr are sent to the House with the
following Message Viz.

Sept. 8th 1704.

By his Excy the Governour and Council in Assembly
Your House being now settled and resolved upon revising
the Body of Laws of this province We recommend unto Your
Serious Considerations several of her Majesties royal Instruc-
tions laid before you the last Assembly viz:—

1. The raising of Supplys for defraying the publick
Charge on which occasion you are to take especial Care that
