purchase Drums and Colours and other Necessarys for the
Company as the Comander shall direct.
Provided that this Clause be not construed to Countenance
any Officer to press Arms or Amunition for any further Kxpe-

dition or Service from training out that upon all such Occa-
sions they shall be supply'd out of the County Magazine
or store all which fforfeitures shall be adjudged heard
and determin'd by such Colonell Major or Captain of
any foot Company as aforesaid and account thereof kept
in writing by the Clark of such Company which said
Colonell Major or Captain of such Company as afore-
said is hereby authorized and impowered to award exe-
cution against the goods and Chattells of such persons so
refusing neglecting or failing as aforesaid and that upon occa-
sion of all such Execution the respective Clerks and Sheriffs
of each respective County within this Province shall issue, out
and Serve Execution without any ffee or reward. And for the
settling of Horse fforces That a Captain of each respective
County for making up of his troop Elect and enlist his number
of Men out of the Inhabitants of the said County according to
such Instructions as he shall from time to time receive from
the Governour of this Province for the time being Provided
allways that such Troopers shall ride their own Horses And
that no person shall be a Trooper without he be Owner of a
good Serviceable Horse which shall pass Muster And that
such Troopers in Consideration of their great pay hereafter to
be allowed be bound and obliged to find themselves with good
able and sufficient ffurniture for the Horses and likewise to
find themselves with Swords Carbines Pistolls Holsters and
Amunition And if any Troopers shall neglect or refuse upon
notice given them as aforesaid (to the foot) to appear at
Musters at the time and place appointed as aforesaid by each
respective Captain of Horse accounted as required as afore-
said shall forfeit and pay the sume of one hundred pounds of
Tobacco to be levyed as aforesaid to the use of the Troop (for

the purchasing of Trumpetts and Colours and other necessarys
as the Comander shall think fitt And that all such Troopers for
and in Consideration aforesaid at all such times as they are
out arranging shall find their own Provisions but when in
Actuall service to be found Provisions at the Charge of this
Province to be paid by the Publiq And if it shall happen that
any Troopers Horse should be Killed in the Service then the
said Trooper to be paid for the said horse by the Publiq and
not otherwise ffourthly that all persons in holy orders Dele-
gates Magistrates and Constables shall in their proper per-
sons be exempted from being compelled to muster and train
either in horse or ffoot during such time as they Officiate or
