Orderd Mr Robert Gouldesbourough Mr Thomas Frisby
Mr Iames Phillips & Mr Iohn Wells carry up to his Excy and
Councill the following message.

By the house of Delegates.
Septr 7. 1704

In Answer to A message sent to this house from his Excy
the Governour and the honoble Councill by Thomas Tench &
Robert Smith Esqrs Yesterday the house orderd that the
thanks of this house be given to his Excy for this kind Expres-
sions of A tender reguard he hath of the libertys and privi-
leidg's of the members of this house Exprest in the said Mes-
sage, and they doe humbly hope that his Excy will be pleasd to
Continue the same. Signd p order

They returne and say they deliverd their Message.

Moovd by a member that for-as-much as Mr Iohn Hamond
A Delegate for Ann Arrundell County has Absolutely denied
and refused the oaths Appointed by law & is Altogeather un-
capeable to Serve in this house

Jt is therefore orderd that Mr Speaker issue his Warrant to
her Maj" principall Secretary or his Dty to make out A new
Writt of Election for A member instead of Mr Hamond to
serve in this Assembly.

Which Accordingly issued, and sent the honol Secretary or
his Deputy by the hands of George Muschamp Esqr

Whoe returnes and says he deliverd the same.

Orderd by the house that Mr Samll Young one of her
Majestys Iustices of the provinciall Court and A member of
this house call before him George Vallentine Serjeant Attend-
ant and Moses Adney door keeper And Admster to them an
oath that they or either of them shall not directly or indirectly
declare or devulge any of the debates or Secretts of the house
so long as they Continue in such offices.

Mr Young returnes into the house and says he has Adms-
tred such oath to them

Bill for regulating ordinary's &ca brought into the house.

Read the first time & endorsd that it doe pass and prayd
that his Excy the Governour & Councill will concurr therewith
