82 Proceedings of the Council of Maryland, 1700.
Lib. x. olson his Majestys Governor of Virginia he met with W Samuel Chew, Richard Johns Samuel Galloway & Nehemiah Burkitt who gave him a certain order under Seal of his Maj esty in Council which is as Followeth
At the Court at Kensington the 30th November 1699 Present The Kings most Excellent Majesty in Council Whereas by Powers granted under the great Seal of Eng p. 228 land to Colo Francis Nicholson Capt General & Governor in chief of his Majestys Provs of Maryland in America dated the 10th day of Feby in the fifth year of his Majestys Reign as also to Colo Nath Blaki3ton Captain General & Govr in chief of the said Province dated the 19th day of October in the tenth Year of his Majestys Reign the Governor Council & Assembly of that Province have been impowered to constitute & Ordain Laws which are to be in force until his Majstys Pleasure be signified to the contrary & forasmuch as in pursuance of the said Powers two Laws have past in the General Assembly of the said Province in the year 1696 & 1699 the first intituled an act for the establishment of the Protestant Religion within this Province wherein is a clause declaring all the Laws of England to be in force in Maryland which Clause is of another Nature then what is set forth by the Title of the said Law the other Law being an act ascertaining the Laws of this Province which Laws having been perused by the Lords Commsrs of trade & Plantations & thereupon presented at this Board for his Majestys Determination concerning the said Laws His Majesty in Council is pleased to signify his Disappro bation & disallowance of the said Laws & according to his Majestys pleasure the said Laws are hereby repealed & declared void & of none effect J no Povey
Which being read & considered & divers Arguments & debates had thereupon his Excellency is pleased to ask the Gentlemen of the Council whether they do not think it p. 229 Adviseable that he should immediately Issue a Proclamation signifying the Repeal of the said Laws to which they sever ally agree Answer & Advise his Excellency to defer the issu ing of such Proclamation for the following reasons vizt 1st In regard there is not a full Council at this time there being only three present at the Board & the others Living so
