74 Proceedings of the Council of Maryland, 1699.
Lib. x. Provisional Court residing in Somerset County do inquire thereinto & remove the said Parkers fonceable entry accord ing to Law & for the better Satisfactions of the said Indians. Read the petition of Mr John Contee the Factor of Sr Iohn Rogers of Plymouth praying the Assignmt of Major William Whittingtons & Mr John Wests Sheriffs Bond for Somerset County against whom the said Sr John Rogers has a claim against the one for 4661 l Tobo & the other 17387 l tobo His Excellency & the Board are pleased to express the Re spect they have for the said Sr John Rogers who is a consid erable trader in this Province & order that the said Sheriffs P. 218 Bonds be assigned & a Special Court Granted to sit the first Tuesday in July next & that Mr Walter Lane Capt Richd Hill Capt Wm Holland Mr James Sanders & Mr John Worthington be appointed the Comrnsrs for holding the said Court Flis Excellency is pleased to lay before the Board that the Sheriff of Calvert Countys Office will very shortly be vacant & that two Gentlemen of that County vizt Mr Blake & Mr Wilson had both of them made their application to him therefore Mr Blake is recommended by the Board to his Excellencys Favour for that he has always been very ready & serviceable in this his Majestys Government Whereupon his Excellency is pleased to order a Commis sion to be prepared constituting the said Mr Thomas Blake high Sheriff of Calvert County upon the Present Sheriffs Commission determining accordingly John Pope of Somerset County made his Complaint that he had been indicted at the said County Court for some scan dalous words by him spoke of Mr Mathw Scarborough one of the Justices of that County that he confessing some of those words tho not the whole & craving a Reference until the next court to produce his Evidence to maintain what he said was denied & forced to come to tryal that Court without his Evidence & was Sentenced to be imprisoned three months & be fined four hundred pounds of Tobo & further that the said Pope happening to be overtaken in Drink Scarborrough p. 219 malitiously followed him from house to house & teazed him so that he swore very much for which he is heartily sorry upon which the said Scarborrough had him presented & fined for the said oaths to the value of ten pounds Sterl he also further alledged that the said Scarborrough stands indebted for what he had taxed him with Ordered that the Justices of Somerset County make exact inquiry into this matter & certify the truth thereof to his Excellency the Governor with the several depositions & pro ceedings against the said Scarborrough & that the Levying
