that he was but newly arrived he did not know what construc- Lib. X. tion the people might put upon such adjournment & that for those reasons he had wrote to the Governor of Virginia that Major Dent could not then wait upon his Excely being so p. 216 Concerned for his Majesty & others as aforesd Elis Excellency acquaints the Board that he had Ordered Major Smallwood to acquaint those Indians that if they would come in here & quietly set down they should be kindly dealt with but has not as yet heard from the said Major Smallwood His Excellency says he is informed that there are three Ships now trading in this Province wholy owned by Scotch- men & that one of the Masters vizt Captain Lathrop being questioned had produced Edwd Randolph Esqr his Majetsys Surveyor Genl on the Continent of America his Letter in his Favour signifying that Liberty of trading into these Provinces is now allow'd to Such Scotchmen & laid a copy of the said Letter before the Board which was read as also his Excel lencys Instructions dated the 4th of October 1698 relating to that affair which this Board having considered likewise the several Acts of Trade & Navigation are of Opinion that in regard neither his Excellency nor any of the Officers of his Majestys Customs here have received any such Notice on Advice of such Toleration from the honble the Commsrs of his Majestys Customs or the Right honble the Lords of the Council of Trade no regard ought to be had to the said Letter but that the acts of trade & Navigation should be put in force His Excellency acquaints the Board that he has lately rec'd two Letters from the night Honble James Vernon Esqr his Majestys Secry of State the one directing him to use his utmost Care & Diligence to apprehend Captain Kidd the Pirate & his crew in case any of them should come into this Province upon Which Occasion he had issued particular War- p. 217 rants to every County in the Province The other Letter directing his Excellency to prohibit any Supply of Arms or Provisions from this Provs to the Scotch Settlement at Darien whereupon he had issued his Proclama tion to prohibit any such supply from this Province Produced & read a Letter from Mr Walter Lane & Mr Rowland Bevine complaining of one John Parker who had intruded upon & built an house within the Bounds of the Land laid out for the Indians in Somerset County of which the said Indians complain & the said Gentlemen further ac quaint his Excellency that they fear some disturbance may be occasioned thereby His Excellency with the advice of the Board does thereupon order that Mr John Rounds one of his Majstys Justices of the
