          Appendix to Council Proceedings, 1696-1729.  559

    

     have a warrt to bring the sd seamen before them but that       B. M.

     neither the Governr nor they could nor would secure them for   Vol. 25.

     him unless he would lay fellony to their charge saying they

     were true borne subjects of Engld & tht they only loose their

     wages & therefore would rather encourage them than rebuke

     them adding that they wanted men to mann their ships &

     cared not if all the men in Maryland would leave their ships

     they would be welcome to them

      Charles Hemsley made oath

     in open court that what is

     herein contained is true

     Signed p. Ordr 5 Dec. 1696

      Came Peter Oldson the day & yeare aforesaid & made oath

     that he did employ the sd Charles Hemsley to goe after the

     said seamen & that he did not bring them wth him.

     Jur. in Cur. die supra.          H. Wriothesley clk.

    

      And this Depont further saith tht the Justices to whome ap-

     plicacion was made for the sd Peter Oldsons men was Cornelias

     Empson & Adam Peterson & two other Justices whom this

     Depont knows not their names but they are Justices of the

     County & live in New castle Coty

                      Jur. in Cur. 8 die Dec. 1696.

      The Deposition of Jno Taylor of Dorchester Coty in the

     Province of Maryland gent. aged thirly four yeares or there

     abouts

                         This Depont saith

      That about the beginning of Octobr last past being at New

     castle within the Province of Pensilvania at one George Lambs

     house he hapned into compy there wth severll of Capt. Dayes

     crewe belonging to the Privateer Vessell rideing before tht

     Town three whereof were sd to be officers vizt two Quartr mrs

     & a Gunner & in discourse told them that if his wife would

     lead his horse back he did not care if he went with them

     understanding by their discourse tht they were bound to the red

     sea who did voluntarily shew to this Depont their Articles

     WCII were not then signed but told him that they would be

     signed the next morning as soon their capt. came to Towne

     who was then expected part of the Articles (according to the
