546 Proceedings of the Council of Maryland, 1731.
Ljb. M. Esqr in the City of Annapolis appeared the Honourable Sam uel Ogle Esqr in Presence of the Honble Charles Calvert Esqr Philemon Lloyd Esqr Col Richard Tilgnman Col Matthew Tilghman Ward John Rousby Esqr Benjamin Tasker Esqr and Philip Lee Esqr Members of His Lordships Council and pro duced His said Lordships Commission constituting and ap pointing him the said Samuel Ogle Lieutenant General and Chief Governor of the Provinces of Maryland and Avalon in America, & also Commander in Chief both by Sea and Land of all the Forces raised or to be raised in the sd Provinces; which being published and read, is ordered to be recorded in the Secretary's Office His Excellency the Governor took the several Oaths ap pointed to be taken by Act of Assembly of this Province as also the Oath following I Samuel Ogle do swear that I will be true and faithful to the Right Honourable Charles Lord Baron of Baltimore the true and absolute Lord and Proprietary of this Province of p. 48 Maryland and his Heirs and him and them his & their Rights Royall Jurisdictions and Signiorys all and every of them into and Over this his Province of Maryland the Islands & Terri torys thereto belonging I will at all times defend and Main tain to the Utmost of my power and will never Accept of any place Office or Imployment within the said Province any ways concerning or relating to the Government thereof from any person or Anthority but by from or under a lawfull Authority Derived or to be derived from his said Lordship his Heires or Assignes, I will faithfully serve his said Lordship as his Gover noun or Commander in Chief of the said Province and in all other offices committed to my Charge by his said Lordships Commission or Commissions to me and will willingly yeild up the said Commission or Commissions again and all Offices powers and Authoritys granted or to be granted by them or any of them into the hands of his said Lordship and his heires and Assignes or to such person or persons as he or they shall Appoint whensoever he or they shall Appoint me so to do and shall Signifle the same unto me. And will not presume to put in Execution or Attempt to Execute any Office Power or Authority Granted unto me by any of the said Commis sions after that his said Lordship or his heires or Assignes Lords and Proprietarys of the said Province shall repeal them or any of them respectively and that the said Repeals be pub lished within this Province. I will do equall Right and Justice to the Poor and to the Rich within this Province to the best of my Skill Judgment and Power According to the Laws and Ordinances of the said Province and in default thereof Ac-
