    amongst Powlsons papers as a thing of no Consequence and Lib. X.

    therefore did not Concern himself any further about it

      Upon which Mr Iobson was again Sworn who deposed as

    followeth

      That the said Bordley was no ways a Promoter Adviser or

    Instigator in the taking the said Deposition (otherwise then

    as aforesaid) but that it was Intirely done by him the said Job-

    son and necessary as he Apprehended for his own safety in

    delivering up the Bills mentioned in the said deposition

      Sworn to at this Board Thomas Iobson

       test

      Whereupon this Board humbly Answer his Excellency as

    follows

   

   

    May it please your Excellency

      Having taken into our serious Consideration the matter re

    ferred to us in relation to the powers necessary for the taking

    notice of the proceedings of sundry Persons at the taking the

    Depositions of Thomas Iobson which your Honour was plea

    sed to lay before us we are humbly of Opinion by the Allega

    tions of the said Bordley and by the depositions of the said p. 140

    Iobson this day taken at our Board Concurring therewith that

    no Affront was designed to the person of the Governor of

    Maryland in the manner of Giving that Deposition Altho

    there was just Grounds of Suspecting it until the Circum

    stances of that Affair had been specially inquired into for the

    Deponent seems to us in the reason as well as in the manner

    of giving that Deposition to have no other views than those

    of Iustifying himself in case any Clamours which he was then

    very much afraid of should be made against him for the resti

    tution of those Bills of Exchange in the Deposition men

    tioned from the Parties to whom they had been adjudged by the

    Courts

      Wee presume therefore to advise your Honour that in our

    humble Opinion the use of powers not supported by Law is

    the only means whereby some people may have a handle for

    Censuring your Honours proceedings with Impunity and

    therefore hope your Honour will Concurr with us in believing

    that the use of powers in the present Case are altogether

    unecessary and Inconvenient

      Ordered by their Honours that search be made amongst the

    Council Records for a Commission formerly Granted to the

    Council of this province and produced at the next sitting of

    this Board
