p. 34 To his Excellency Charles Calvert Esq Governor and the Honourable Council of Maryland The humble Remonstrance of Thomas Truman Greenfield Sheriff of Saint Marys County
Humbly sheweth That your Declarator serv'd a writt of Retorno habendo in April last upon six Negroes then in possession of a certain Mary Phippard to the use of George Forbes which Negroes were appraised as the estate of Kenelm Cheseldyn deceased at one hundred fifty nine Pounds as p the Inventory of that estate may appear Now may it please your Honours this being an Extraordi nary writt and such as the Law has not ascertained the fees for I applied my self to the Iustices of the provincial Court for the Regulation of my Fees in that Case having taken notice of a paragraph in the Act for Limitation of Officers Fees Folio 47 wherein it is said for serving an Extraordinary Warrant or Commission to be regulated by the Court which Court I Con ceived was that which the Precept was returnable but the Court was of another Opinion and referred me to your Honours who is therefore humbly prayed to Ascertain them with regard had to my Great Trouble some of the said Negroes being Conceal'd in the Woods and the Execution of as much Hazard as a Replevin Which favour will always be thankfully acknowledged by Your Excellencys and Honours November 7th 1721Most Obedient humble Servt T T Greenfield
Which said petition being read and Considered was Ordered to be thus endorsed vizt
