344 Proceedings of the Council of Maryland, 1716/17.
C. P. Thereupon the said John Beard takes the Severall Oaths Appointed to be taken by the Act of Assembly of this Prov ince, And Also An Oath for his due Execution of the aid Office. His Excellency Acquaints the Councill the Comission Obtained by Mr Carroll Especially that for the Navall Officer (he being a Papist) had given very great Offence to the Country as they very well know Wherefore to Satisfy the minds of the People he thought fitt to let them know after what manner Mr Carroll had obtained those Comissions And Comunicated to the board a letter from the Right honble the Lord Guilford to him dated the Eleventh day of October 1716 Wherein his Lordship is pleased to say that the Govern- our's kind recomendation of Mr Carroll was one Principall motive that induced the Ldships to imploy him at all. And further Acquainted him that Mr Low affirmed to his Lordship, and Mr Carrolls Comission had been drawn and (as he re members) ingrosed the said Mr Carroll told him two or three days before his departure that now his Lordship was restored to his Government he must have the words Navall Officer put into his Comission because his Lordship had now a right to name him, whereupon he told his Lordship what Mr Carroll had sayd not at all Imagining the Governours Authority woud be lessened or Mr Carrolls Profitt raised thereby And thereupon the words Navall Officer were inserted and his Comission Sealed. Whereupon his Lordship Observes to his Excellency that the words Naval Officer were inserted thro' Surprize As to the Incapacity of Papists Serving in Publick Imploy ments his Lordship (declares he) pays the utmost deference to the Law And by his said Letter Authorizes his said Ex cellency to Appoint Navall Officers & Says he will do every thing that shall be thought necessary to superseed that part of Mr Carrolls Comission Mr Lowe in the next Paragraph of his letter Observes to his Lordship that he was intirely unacquainted with the nature of the Offices of Surveyors & Navall Officers and the manner of Conveying them And if there has been any error made either in the disposall of the surveyors or Navall Officers places the Governr must Attribute it to his friend Mr Carroll. Then his Lordship the Lord Guilford Observes that as to the Surveyors he shall Authorize his Excellcy to Appoint the Severall Surveyors in the Counties dureing pleasure And in the mean time he Comands his Excellency the Governour to hear all disputes and Complaints that shall be made to the Surveyor Generall.
