sixth Year of the Reigne of her late Majesty Queene Anne Lib, W. B. of Glorious memorie Intituled an Act for the Security of her Majesties Person and Governmt and of the Succession of the Crowne of Great Britain in the Protestant Lyne All Publique Seals and the Privy Signett used at the Tyme of her late Majestys Demise were to be made Use of till his Majesties further Direction. His Excellency lay'd before the Board one other Letter from the Rt Honble the Lords of the Council of Trade and Plan tations as follows Viz.
White Hall August the 19th 1714 p. 32 Sr Her late Majesty having been informed tht an Illegal Trade has been carryed on between severll of the British Plantations in America and the French Settlements in those Parts to the Prejudice of the Trade of this Kingdom and in Violation of the Laws thereof and the ‘I'reaties between this Kingdom and France; Their Excellencies the Lords Justices have Comanded Us to send You the following Extract of the Treaty of Peace & Neutrality in America Concluded between England & Prance 6/16 day of Novr 1686. By the fifth and Sixth Articles of the sd Treaty The Subjects Inhabitants &c of each Kingdom are Prohibited to Trade and fish in all Places Possessed by the other in America And tht if any Ship shall be found Trading contrary to the sd Treaty upon due Proof shall be Confiscated, but in case the Subjects of either King shall be forced by Stress of Weather Enimies or other Necessitys into the Ports of the other in America They shall be Treated wth Humanity & Kindness and may provide themselves wth Victuals and other things necessary for their Sustenance & Reparation of their Ships at Reason able Rates Provided they do not break Bulk nor carry any Goods out of their Ships exposing them to Sale nor receive any Merchandize on Board under the Penalty of Confiscation of Ships & Goods. We further find by the fortieth Article of the Instructions p. 33 to the Captains of the Ships of War, that the sd Captains are Expressly restrained from taking any Goods and Merchandize on Board the Ships Upon all which we are Comanded to Signifye unto you tht you take particular Care for the future tht the foremencon'd Treaty be Punctually observed & put in Execution And that no Illegal Trade be Carryed on between his Matys Province of Maryland under Your Governmt and the French Settle ments in America by any of his Matys Ships of War attending
