Lib. x. them in the Ship whereupon Captain Mitchel not being then On Board the Deponent caused some of the Ships Crew to hollow on Shore for him and proposed that whereas the Wind was Southerly that Captain Mitchell should send his Pinnace to Chester to fetch the men Captain Bostock had Lent him who very readily agreed to the Proposal but the said Captain Bostock saying he was a Gentlemn by his Com mission threatning to take three of his best men tho he had thought to take but two & that his Commission would bear him out of it & calling Capt Mitchell Dog and Rogue swag gered & swinging his Cane over his head threatned to crack his Crown and tho the Deponent Offered to the said Bostock that it would be ruinous to the Ship & Cause her to p. 314 Lose her convoy which she might Now probably hope to go with provided he did not so Disable her by taking away the chief mate & men he would not hearken thereto but swear ing Damn him Damn him cut him down bad his men throw the mate head foremost & Carried him away with two other men belonging to the said Ship swaggering & hectoring what he would do to the said Mitchell & Ship & that he would if he could but get him into the Bay take both him and his Ship whereupon the Deponent said he hoped the said Bostock would not forget his Commission & Turn Pyrate J urat cor nobis James Sanders Tho Tench Jno Hammond
Maryland Annapolis Friday March the 5th 1702/3 Then came before the honble the President & Council Capt James Mitchell Commander of the ship Owners Adventure of London now riding in South River in this her Majestys Province and did Solemnly declare in the presence of Almighty God the witness of the Truth of what he said that on Tuesday the 2d Instant One Wallace Mate to Captain Bostock Commander of her Majestys Advice Boat Eagle about six of the Clock in the Evening came on Board his Ship in the Pinnace Belonging to the said Advice Boat together with the Boats Crew who Stiled him Master where upon the Attestant desired him to walk aft & entertained him very kindly till very late between twelve & one of the P. 315 Clock as he Believes & then ordered a Bed and Supper in an Ordinary on Shoar by the said Ship to be got ready for the said Wallace who then told the Attestant that he was ordered by Captain Bostock to bring away the two men he had lent him or otherwise the two best men on Board whereupon the Attestant demanded by what Authority & thereupon the said
