Wallace pull'd out of his Pocket an Order or warrant which Lib. X. the Attestant did Conceive and verily believes was the order or warrant of the honble President lately given said Wallace upon his being sent with a Sloop for relief of a certain ship run on the Tangier Islands & verily Believing him to have no Authority to impress any of his men turned him & the Boats Crew from on Board the Vessel after which the next morning said Wallace Came on Board again and was something milder but the Attestant finding him to have no Authority to impress his men told him he should have none of them whereupon the said Wallace left the ship and the attestant endeavoured to make his application to the President for his Protection but not finding him at home did apply himself to the Honble James Sanders Esqr one of her Majestys Council who at his request came on Board the Attestants Ship & was perswaded to tarry on Board all night where early the next morning came Captain Bostock with the Boats Crew & Chi rurgeon and entring on Board bad his Crew Ask for the chief Mate & heave him into the Boat & two men more which they took away abusing hacking & cutting the mate who was unwilling to go with them the said Captain Bostock swearing many Execrable Oaths much Abusing the Attestant Damning him & the Voyage & threatning when the Attest- ant came down he would Seize the Ship & ruin him saying p. 316 he would meet him in the Bay & then bad the Attestant stand clear & when the Honble James Sanders Esqr of her Majestys Council as aforesaid seing the Violence used as aforesaid in her Majestys name commanded the peace Cap tain Bostock swore that he would warp his Ship along the Attestants ship Side Iur cor nobis Thomas Tench James Mitchell Jno Hammond James Sanders Also was read the honble Presidents Colonel John Hammond and Mr James Sanders Letter of the 5th of March to his Excellency the Governor of Virginia Vizt
Maryland Annapolis March 5th 1702/3 May it please your Excellency We are heartily Sorry that we have this Occasion given us to acquaint your Excellency of the ill Behaviour of Captain Bostock Commander of her Majestys Advice Boat Eagle upon which we trouble you with the inclosed Papers being Dep- ositions Council proceedings and his Sailing Orders for your Government
