    & some others belonging to the ship Seized in Lynn haven Lib. X.

    Bay and went on Shore at Kiquotan About Sixteen days ago

    yet notwithstanding hath not as yet made any Steps towards

    bringing her to trial so that your petitioners Voyage & trade

    is much impeded and Damnified wherefore he humbly prays

    that notwithstanding such Seizure so as aforesaid made by the

    said Mr Randolph for Which there is no Colour or Pretence

    whatsoever your Petitioner may be admitted to give good

    Security to answer Any information to be exhibited by the said

    Edwd Randolph in England or else where against the said

    Ship and Cargo & upon giving such may be permitted to go

    on with his Voyage & Trade here as other her Majestys Good

    Subjects               And he shall ever pray &ca

   

   

      Whereupon Mr Atty Genl was sent for & also Mr George P. 294

    Plater naval Officer at Puttuxent who said he had received a

    Letter from the said Mr Randolph alledging the said Ship had

    Broke Bulk and the said Petition being Considered & that it

    would be a Loss to her Majestys Revenue to stop the Vessel

    in her trading & Loading Tobacco it is resolved that the said

    Master have leave to trade Giving security in the cum of three

    thousand pounds Sterl to answer any information by the said

    Mr Randolph to be exhibited against the Ship & Cargo upon

    the aforesaid Seizure and thereupon came Capt William Bates

    George Plater Esqr her Majestys Receiver of Puttuxent being

    present and offered Mr Wm Nicholls Mr Thomas Hynton &

    Mr Charles Lanceleys of Calvert County for his Securitys

    whom the said Mr Plater approved of & was ordered to take

    Bond accordingly

      Elias Nutwells Petition read & referred to the Common Law

    Upon Edmund Jenings Esqr his Letter of 23d of Septr 1702

    as followeth

   

   

    Honble Sir

      The Occasion of this is by his Excys Commands to Acquaint

    you that yesterday morning was seen in Lynn haven Bay a

    very large Ship wearing a Flag or very broad Broad Pendant

    at the Top mast head and supposed to be an Enemy his

    Excellency thinks it very much for his Majestys Service and

    desires with all Expedition you will Order Captain Bostock

    with her Majestys Advice Ship under his Command down

    into this Government Time will not further Admit me to add

    more than that I am
