The Lower House. 383


The Serjeant brought the said Lowe to the barr of this
house where he was rebuked for his misdemenour, and the sd
Lowe being demanded by Mr Speaker if he would take the
oaths and quallifye himselfe to sitt in this house or noe, he
answered that he would not take them, Therefore desired to
be dismissed the house, and was thereupon accordingly Dis-
missed
The petition of Christopher Smythers for Naturalization
was read and granted
The petition of Wm Dyer read and rejected for that the
house conceiues, this Province in noe wayes obliedged to pay
such officers
John Hamond and James Saunders Esqrs from the Councill
enters the house, and bring with them
Bill for settleing a Revenue &c. Endorsed thus
Read the first tyme, and will pass with the aboue amendmt
Bill for regulateing ordinaryes, with amendments
The petn of Sir Thomas Laurence read in the house & being
debated they say the bill has been proceeded on to the second
reading, and the Councill has given measures for theire assent
soe that the house will not recede from what they haue done
there being noe sufficient reasons, to induce them to itt order-
ed to be Endorsed on the said Petition
Petition of Charles Pye read & recommend to the committee
of Laws for theire perusall to prepare a bill for his reliefe
The honble Thomas Tench and Thomas Brooke Esquires
enters the house, and Delivers Mr Speaker the following
message

By his Excy the Governr and Councill in Assembly
Aprill 28th 1704

P. R. O.

Its conceiued upon the Debate of her Majestyes Royall
instructions, concerneing the State of Enacting the Laws of
this Province, that the words ought to be (by the Queens most
Excellent Majesty, by and with the advice and consent of her
Majestyes Governt Councill and genll assembly [of] ths prov-
ince and the authority of the Same
Signed p order W Bladen Cl Councill

Resolved to be obserued
Mr Samuell Young and mr Robert Bradley sent up to his
Excy and Councill to desire a conference to debate some mat-
ters in the act for regulateing ordinaryes
They returne and Say that his Excy is pleased to appoint a
conference tomorrow morneing, and that Robt and Wm Hol-
