The Council in Assembly again Sat Present as yesterday
Came Mr Willm Harris & five other members from the
House and bring up three Bills
For regulating ordinarys &c For reviving some Tempo-
rary Laws, & for appointing a Committee to lay the publick
Levy this present year
The Bill for regulating ordinarys &c being read and re-
quiring further Time to debate than this present Session will
admitt of is referred by this Board to the Consideration of the
next Assembly
The Bill for reviving some temporary Laws read the first
time & will pass
The Bill impowering the Committee to lay the publick Levy
read the first & second Time & will pass with this Alteration
in the 3d line vizt only to assess & apportion the publick charge
for this year
The Council in Assembly adjourned 'till 2 of the Clock in
the Afternoon

The Council again Sate Present as in the morning
Came Mr Parker & Mr Lynes from the House of Delegates
who saw Mr John Bosman make oath to his Naval officers
Accompts
The Petition of Capt Arnold Elsey and Mr Richd Chambers
was read praying an Act of Assembly might be made for the
Sale of some Lands late of Capt Henry Smith of Somersett
County decd for the payment of his just Debts & the sd Prayer
of the Petitioners being thought very reasonable by this Board
Ordered that it be recommended by the House of Delegates
for a Bill to be prepared pursuant to the Petition upon a due
hearing of all Partys interested against the next Session of
Assembly and that in the mean time the clerk of the Council
send a copy of the sd Petition & Summons to such as are con-
cerned with the said Capt Smith's Estate that they fail not to
appear at the next Session of Assembly whensoever held in
order to be heard for or against the passing of the said Bill
Col Willm Whittington's Petition read setting forth that
whereas he had built & sent out a Ship called Hannah which
happened to be taken by the French She being laden with
Tobaccoes for which he had upon her clearance in this Prov-
ince payed the Duty of two Shill & six pence p Hhd
He therefore prayed that Sixpence p Hhd might be returned
him, In answer whereto the Board are willing he should have
3d p Hhd the Duty properly to the County returned him but
