Fryday March 20th 1701/2

The Council in Assembly Sate Present as yesterday
It be represented on behalf of the Vestry of St James's Par-
ish in Ann Arundel County, that Whereas Mr Henry Hall the
present Incumbent upon his being appointed to the said Parish
had by the said Vestry paid unto him a considerable Sum of
Tobo of the 40lb p poll which had been raised before his
Appointment to the sd Parish he promising to refund the
same in Case ..... the Governeur and Council should
adjudge the same not to belong to him
And this Board being of opinion that all Tobo raised by
the 40lb p Poll whilst no incumbent in the Parish and lodged
in the Vestry's Hands is not the right of any minister who are
only by Law entituled to that part of the 40 lb p Poll propor-
tionable to such Time they shall officiate in their respective
Parishes, and that such Tobo ought to be applyed by the
Vestry for the use of the Parish
Ordered therefore that the said Mr Hall refund the Tobo so
by him received to the Vestry of the said Parish by them to
be applyed as aforesaid
Read the Petition of Mr Thos Reynolds Sheriffe of Ann
Arundel County and of Several other Sheriffs with their Rea-
sons therewith. Offered for their longer continuance in their
Offices than three years now by Law limited which is well
approved of and thought reasonable

Resolved the said Petition with the Reasons offered be
recommended to the House viz.

By his Excellency the Governour & Councill in
Assembly March the 20th 1701

This Petition and the Reasons therewith offered having
been read at the Board It is recommened to the House that
they would take the Same into their Consideration and agree

with this Board that suth Sheriffs should be longer continued

in their offices than the Law now allows of in case they shall
be well approved of by the Justices and grand Jurys of their
Countys and so represented to his Excellcy the Governour but
in Case they shall not be so represented by the Justices and
Grand Jury in full Court that then the Law May Stand as it
is now and that it may not be in the Governours Power fur-
ther to Continue them
