548 Appendix to Council Proceedings, 1696/7-98.

O. other way than what is directed and agreed in the said Articles of Madrid and other Treaties, And you are particularly not to grant Comissions of Warr or Reprizalls against any Prince or State or their Subjects in amity with Us, to any person what soever without our speciall command. You are not to admitt or allow of any Appeals whatsoever to be made from the Governor and Councill unto the Assem bly. But whereas we judge it absolutely necessary that all Our subjects may have liberty to appeale unto Us in cases that may deserve the same Our Will and Pleasure is that if either party shall not rest satisfied with the judgement or sen tence of Our Governor or the Cornander in Chief and Coun cill, they may then appeal unto Us in Our Privy Councill Pro vided the matter in difference exceed the real value or summe of £300 sterling and that such appeal be made within one fortnight after sentence and security first given by the Appel lant, to answer such charges as shall be awarded, in case the sentence of Our Governor or Comander in Chief and Coun cill in Maryland be confirmed. Provided also that execution be not suspended by reason of any such appeal be too fre quently and for too small a value brought unto Our Governor and Councill. You shall therefore with the advice of the Councill propose a Law to be passed wherein the method and limitation of Appeals unto Our Govr and Councill may be settled & restrained in such manner as shall be found most convenient and easy to Our Subjects in Maryland. And whereas Richard Rawstone late Deputy Collector of the Eastern shore in Our Province of Maryland has repre sented by his Petition to Us that having seized two vessels which had made no Entry they were unjustly extorted from him by means of Henry Darnell & Nicholas Seawell, two of the Judges there, and the Petr was imprisoned to his very great damage & impoverishmt and therefore humbly praying that all Records against him since the year 1685 may be pro duced and that he may be reheard thereupon in the Provincial Court and in Talbot County Court within Our said Province and that he may have liberty to prosecute the said Seawell and Darnell for the losses and damages susteined by the PetT in this behalfe Our Will and Pleasure is that all actions and records against the Petitioner in Maryland since the year 1685 be produced and that he be reheard according to the Petition ers' request thereupon, and that the Petr have liberty to prose cute the said Seawell and Darnell for the losses and damages he has susteined in this behalfe. You shall endeavour to get a Law passed for the restrain ing of inhumane severities which by ill masters and Overseers may be used towards their Christian servants or slaves, and
