368 Proceedings of the Council of Maryland, 1696/7-98.
Lib. H. D. Your Peticoner humbly prayes he may be admitted thereinto, being freely willing to bestow all the Proffits, perquisitts & fees of the two first years thereby accruing unto the use of p. 619 the said School, wch (if granted) he desires may be laid out in building a Warehouse to the use aforesaid, and that in Order thereto there may be assign'd, such a convenient quantity of ground as the Law in that case directs, so soon as the time limmitted by the Act for building Warehouses is fully expired. That yor Petitioner designes building a Twenty five foot dwelling house this next Summer, having already agreed & paid for the frame thereof to be delivered him in the Spring, wch is to be a good Substantiall saw'd frame wth Coedar posts & groundcells, the wch (if please God yor Petitioner should happen to dye before the end of the two aforementioned years) he freely bequeaths & bestowes to the use of the said School; and provided he may have the sole management and use of the aforesd warehouse, during his naturall life; he freely bequeaths both the one & the other, to the uses afore mentioned, after his decease, and withall humbly desires that the Honoble the Governrs and Trustees of the said Schoole will please to cause this to be made a Record in the Comis saries Office, as his last will and Testament in these two par ticulars, utterly excluding all other Wills, web for the future shall or may be made to the contrary By yor humble Petitionr John Stanley.
Read a Petition of Mr Gerrard Vanswaringhen, humbly pray redress agt Mr Robt Mason high Sherriff of St Maries County for stopping some Publick Tobacco of his, out of pretence of some debt owing by the Peticonr to the said Mason &ca The said Petition was by Order referred to Mr Robt Mason aforenamed who upon refusing to make the Petitioner satis faction; and that if it did appear the Allegations in the Peti tion set forth are true. His Majesties Lawyers are to make such proper proceedings thereon, in behalfe of the Petitioner as in the Law such case directs. Their Exncyes the Lords Iustices Proclamation for publishing the peace &ca and the Order of the Rt Honoble the Lords of the Councill for Trade & fforeign Plantations were by Order read and the Articles shew'd to his Honor Esqr Tench & Coll Courts, who had not before seen them: Then read the direction from the Rtt Honoble the Comissrs for executing the Office of Lord high Admirall of England, Ire land &Ca dated 29th of Aprill last past, & formerly produced in Councill.
