272 Proceedings of the Council of Maryland, 1696/7-98.
Lib. H. D John Salter of Talbott County Innholder signifying to this Board that he was prossecuted by an order hence issued for non performance of a Certain Contract with Talbott County Justices about the Court house &ca sayes he is willing to per forme all Covenants whatsoever by him entred into, and there fore prayes a stop may be putt to the said Action; to which was answer'd, that if he would enter into a Bond for performance thereof and Refund all such sums of Tobacco as he Recd from them for Alterations made in the sd Court house &Ca his case should be considered. And a Bond being accordingly prepared, Read & approved off; the sd Salter is asked if he is willing to sign the sd Bond, which if he did, that then a Stop should be put to the sd Action commenced against him, and withall is told, that there shall no present advantage be taken against him upon the said Bond, but that the same shall lye still till an Assembly to whome his Exncy intends to referr the matter for their opinion; And it is hereby Ordered that no future Repairs be made upon the said house, unless the sd Salter do it at his own charge; ffor that it is not approved off by this Board that his Majtes Court should be held under the same Roofe, where an Ordinary is kept and so many tipling Roomes Round it. The sd Salter does say that he is willing to signe the said Bond upon the proviso aforementioned; which was accord ingly done & lodged with the Clerk of this Board.
October the 23d 1697. The Councill again Sate and were present His Exncy ffrans Nicholson Esqr Capt Genll &ca Sr Thomas Laurence Barontt Secry Collo Henry Iowles Collo George Robotham Thomas Tench Esqr Collo Charles Hutchins Came Madam Elizabeth Blakiston als Rymer Admx of Coll Neah Blakiston Decd and made motion by Mr Phillip Clark her Attorney how tht having lately obtain'd Judgment against the Honoble Thomas Tench Esqr Admr of Governr Copley p. 593 decd for a considerable Sum of money & tht understanding the Esqr Tench was going out of the Province; therefore desired leave might be granted to take such legal process out against him, before his departure, according to the directions of the law in such case. To wch was answered that the sd Esqr Tench being appointed by his Exncy and his Majtes Honoble Councill, by and with the approbation of the Justices
