Lib. H. D. the purview of tht act; therefore prayes he may be discharged therefrom & his Bond delivered him up to be cancelled Ordered that the said Petition be referred to the Kings Lawyers to consult and make report whether by Law he ought to pay the same or not.

May it please yor Exncy We have considered the case of Mr Jones and are of opinion as follows. 1st That the intent of tht Act for Imposition of Tenn p Cent (as by the preamble appears) was only to lay hold of Goods that were transported in & out of this Province for Sale & Traffick, but not such as were for domestick and Personall use &ca 2d That it appears by Major Thompsons Information that the greatest part of those goods he has seen & that they are only the necessary & usefull goods of his personall & Domestick use & the implements of his trade. Therefore upon the whole matter we are of opinion tht the said Goods are not lyable to the Tenn p Cent, either by the Letter or reasonable intent or construction of the said Act wch is humbly submitted by Your obedient Servants Willm Dent George Plater.
The above Report is approved off and the Prayer of the Petitioner granted. Read a Petition of Mrs Elizabeth Tripp of Dorchester County, for remittance of two fines of 500 ls of Tob. each, was granted and the fines therein specyfyed was ordered to be remitted accordingly. Read a Petition of one Kympton Mabbot for remittance of a forfeited Cognizance of his being cast into Prison by John Edmondson, whereby he is brought into a very low condition, and unable to right himselfe, being much injured and wrong'd by the sd Edmondson; therefore humbly prayes Councill may be assign'd him, and that he may be admitted in formâ pauperis Ordered that the said Petition be referred to Geo: Plater Esqr as the Kings Receiver as to the ffine and to the Kings Lawyers for their advice, as to the other matter in Law. Mr Willm Sharp according to summons appearing to answer his contempt & neglect in not sending his EXnCY notice of Admirall Nevills arrivall in Virginia. is dismissed from his
