     At a Councill mett and held by Speciall Appointmt

                 the 5th day of Augt 1697.

                          Present

           His EXnCY ffrancis Nicholson Esq Capt Genll &ca

              Sr Thomas Laurence Baront Secryr

               Coll:     Henry Jowles.

       Kenelm Cheseldyne Esq Commissary Genll being sent for

     came accordingly. His Exncy is pleased to tell him that his P. 539

     Office is a place that his Maty has more irnediately been

     pleased to intrust himself withall the which the sd Cheseldyn

     has recd the benefitt off, without any Gratuity or Reward for

     the Same, in hopes he would have been diligent in the

     Execution thereof, and has had Severall warnings to do the

     Same and keep himself from drunkeness and the like, which

     his EXnCY Says he has Nevertheless not minded, nor performed

     his Duty in keeping his Court according to the day appointed,

     the people being much delay'd and kept in Town at Expence

     and Charge for want of the Courts Sitting.

       The sd Mr Cheseldyn being asked what business there was

     left undone or unfinished in his Office; makes Answer that he

     does not know nor can possibly give Such an Accot

       Ordered that the honrble Sr Thomas Laurence Baront Secryr

     and Coll: Henry Jowles imediately goe to the Commissary's

     Office and there take an Exact list and Acct of all Causes and

     other Matters depending in the Office not yet Compleated

     and ffinish'd and Examine the Records and papers by the

     fformer list thereof taken, to see if none are wanting, and

     Make Return thereof unto his Exncy the Governr with all pos

     sible Speed, And that Mr Gouldsborough be Assistant to them

     therein.

       Ordered that Kenelm Cheseldyn prsent Commissary and

     Mr John Bouije his Clerk be henceforth dismist from Execu
