D. be not contrary to the Orders and Directions given unto you or to be given by Us or the Commrs of our Treasury or high Treasurer for the time being and provided also that you do not in any wise or any other by yor Ordr intermedle with the Moyety of the Two shilling p hhd the duty of 14d p Ton or the Quitt Rents belonging to the Lord Baltemore as Proprietr of our sd Province but that you leave the Same to be Collected and Received, by the sd Lord Baltemore or his Agents without any let or hindrance from you or your under Officers; Given at our Court at Whitehall the Eigth day of Janry 1691 : in the Third Year of our Reign. Coppy Extract of a Letter from Coll Nicholson Govr of Maryland to the Councill of Trade & Plantations Dated the 13th Iuly 1697.
I had from the Rt Honble the Lords of the Admiralty a Cofilission for Vice Admirall of this his Matys Province & theire Ldshps were pleased to Impower me to apoint a Judge Register and Marshall of the Vice Admiralty here wch bears date the 2d of October 1695 And which I Received by our last Fleet from the Honble William Bridgeman Esqr Theire Lord shps Secretary And with humble Submission to your Lord shps I do not find tht any Ship or Vessell can be tryed by the Court of Admiralty for breach of any of the Acts of Trade and Navigation except a Ship or vessell that shall cary any of the enumerated Comodityes to any place but as directed by Acts of Parliamt particularly by one of the 22d & 23d of King Charles the Second Entituled an Act to prvent the planting of Tobb: in England & for Regulateing the Plantation Trade by Virture of wch Act the Ship or Vessell So offending is to be Tryed for the same in any of the Plantations in the Court of high Admirall &c. of England or any of his Vice Admiralls as in page 237 of the Book of Rates &c. Comonly so called. p. 191 And by the late Act of the 7th & 8th of his most Sacred Majestys Reigne for prventing frauds &c. I don't see tht any power is given to try Ships or Vessells in the Court of Admiralty for the breach of That or other Acts of Trade & Navigation Except they are Impowered to do by a Clause in the sd Act page 497 Vizt In any of his Matys Courts of Records at Westminister or in any Court in his Matys Planta
