where either party are protestants they be not marryed but by
a minister of the Church of England. That where ministers
are appointed none be marryed by a Justice of the peace.
That a penalty be imposed one such who marry or are
marryed contrary to the Intent of this Law.
That this be a Supplicatory Bill and that the house make
some declaration Whether or no by the Clause (in the Act for
the Establishmt of the protestant Religion) for registring
Births Marriages and Burials Quakers be not obliged to Regr
their Births Marriages and Burialls wth the Clks of the Vestry.
Ordered that his Ma'ys Attorny Genll draw a Draught of the
said Law for pusall of this Boarde
His Excy is pleased to propose to the Board that Whereas
the House of Delegates do sitt at the Vast Charge of the
Country and will not proceed to doe any Busieness for the
Advantage thereof they should give their Advice what are the
best methods to be used—and desires their answer to morrow
or on munday morning.
This Board adjourne themselves untill to morrow morning
at 8 of the Clock

prsent alsoe the honble Robert Smith Esqr Chiefe Justice of
the Proviciall Court

Came the following Message from the house of Delegates
by Major John Low and four other Members Vizt

By the house of Delegates &
To his Excy the Govr and his Matys honble Councill

May it please yor Excy
Before our last prorogation Wee made Sr humble Addresses
to yor Excy and honble Councill to enlarge Mr Philip Clarke
being a member of this house to Serve in the Assembly
Whereupon yor Excy was pleased to prorogue this house.
And being again mett and still finding the said Mr Clarke in
prison Yor Excy We hope will hold us excused if Wee doe
judge it our Duty to our Country Still to insist on our privi-
ledges and againe humbly to Supplicate yor Excy to Suffer the
said Mr Clarke to Serve in this house.
The house of Delegates in this province haue all wayes
claymed as their Birthright the Same priviledges as the house
Comons clayme in England neither his present Maty nor any
