them under a sufft Guard of the Militia of his County to
Wilmington where they are to be delivered to the Principal
Officer of the Delaware State residing there in order that they
may be sent from thence to Philadelphia with this Order that
they may be there imprisoned till Exchanged. The Conti-
nental issuing Commissaries are desired to furnish the Guards
and Prisoners with Provisions for their Subsistance this being
properly a Continental Charge and no other Provision being
established at least on this Rout.

In Council Annapolis 27th July 1779
Sir
We just now recd your Letter of Yesterday. It is not in
our Power to issue a Warrant agast any Body, unless an Oath
is previously made of such Persons having committed the
Crime for which the Warrant is issued. Any Magistrate is
competent to take your Oath & issue a Warrant and if you
know Wm Sluby to be guilty of High Treason, it is undoubt-
edly a Duty you owe the Public to apply to a Magistrate im-
mediately to have him secured.

[Council to H. Hooper.]

In Council Annapolis 27th July 1779
Sir.
We just received your Letter respecting the British Prison-
ers. For several Reasons we would prefer marching them by
Land to Philada for here we have no Prison which would hold
them an Hour, and they would be quite out of the Way of Ex-
change. Inclosed is an Order for their Route; the Distance
is rather farther than we should have wished your Militia to go
with them but that, we imagine they would be detained any
where else, to get another Guard, and at Chester, we presume
they maybe instantly discharged. If there is no Issuing Com-
missary at or in the Neighbourhood of Cambridge, from whom
you can draw for the Guard & Prisoners 'til they get to
Chester, we request the Favor of you to have Provisions pur-
chased.
