Unto Us in cases that may Require the same Our Will & Lib. H. D. Pleasure is that if either party shall not rest satisfyed with the J udgemt or Sentence of our Governor or Councill they may p. then Appeal Unto Us in our privy Councill Provided the Matter in difference Exceed the Reall Value and Sume of Three hundred Pounds sterling and that such Appeal be made within one fortnight after Sentence and that Security be like wise duly Given by the Appellant to Answer such Charges as shall be Awarded in Case the Sentence of the Governor & Councill be Confirmed And Provided also that Execucon be not suspended by Reason of any such Appe Unto Vs And Wee doe hereby Give & Grant Unto you full power and Authority where you shall Judge any Offender or Offenders in Criminall Matters or for any ffynes or fforfeitures due vnto Vs fit Objects of Mercy to Pardon & Remitt all such Offences ifynes or fforfeitures before or after Sentence Given Treason & Willfull Murder only Excepted in which Cases you shall likewise have power vpon extraordi Occasions to Grant Reprieves to the Offenders Untill our Royall pleasure may be knowne therein And Wee doe by these presents Authorize & Impower you to Colat any Person or Persons in any Churches Chapels or other Ecclesiasticall Benefices within our Province & Territory aforesaid as often as any of them shall happen to be Voyd And Wee doe hereby Give and Grant Unto you the said ffrancis Nicholson by your selfe your Captains & Comanders by you to be Authorized full power & Authority to Levy Arme Muster Comand & Employ all persons whatsoever Residing within our said Province & Territory vnder your Governmt and as Occasion shall serve them to Transfer from one place to another for the Resisting & withstanding of all Enemies Pyrats & Rebells both at Sea and at Land And to Transport such fforces to any of our Plantations in America as occasion shall Require for the Defence of the same against the Invasion or Attempts of any of our Enemies And such Enemies Pyrats & Rebells if occa sion shall Require to pursue and prosecute in or out of the Limits of our said province and plantacons or any of them And if it shall please God them to Vanquish Apprehend & take And being taken either according to the Law of Armes to put to Death or keepe & preserve alive at your discretion And to Execute Marshall Law in time of Invasion Insurrection or Warre as also vpon Soldiers in pay And to doe & Execute all and every other thing or things which to a Captain Generall Doth or ought of Right to belong as fully and amply as any our Captain Generall doth or hath Usually done And Wee doe hereby Give and Grant Unto you full power & Authority to Erect Raise & build in our province & Territory
