Lib. H. D. Notwithstanding And to the End Nothing may be passed or p. done by our said Councill or Assembly to the prejudice of Vs our Heirs or Successors Wee Will and Ordaine that you the said ffrancis Nicholson shall have & Enjoy a Negative Voyce in the Making and passing of all Laws Statutes & Ordinances as aforesaid And that you shall and may likewise from time to time as you shall Judge it Necessary Adjourne prorogue and Dissolve all Generall Assemblies as aforesaid And our Will & Pleasure is that you shall and may Keepe & Use the publick Seale Appointed or to be Appointed by Vs for our Province of Maryland And Wee doe further Give & Grant vnto you the said ffrancis Nicholson full Power & Authority from time to time and at any time hereafter by yourself or by any other to be Authorized by you in that behalfe to Admini ster and Give the Oaths Appointed by Act of Parliament to be taken instead of the Oaths of Allegiance & Supremacy to all & every such person or persons as you shall think fit who shall at any time or times pass into our said province or shall be Resident or abiding there. Wee doe further Give & Grant vnto you full power and Authority with the advice & consent of our said Councill to Erect Constitute & Establish such & soe many Courts of Judicature and publick Justice within our said Province and Territory Under your Governmt as you and they shall think fit and Necessary for the hearing & determin ing of all Causes as well Criminall as Civill according to Law and Equity and for Awarding of Execucon therevpon with all Reasonable & Necessary powers Authorities ffees & priviledges belonging Unto them as also to Appoint & Comissionate fit persons in the severall parts of your Governmt to Administer the Oaths Appointed by Act of Parliament to be taken instead of the Oaths of Allegiance & Supremacy and the Test Unto such as shall be oblidged to take the same And Wee doe hereby Authorize & Impower you to Constitute and Appoint Judges Justices of the peace and other Necessary Officers and Ministers in our province for the better Administration of Justice and putting the Laws in Execucon And to Administer to them such Oath or Oaths as are Usually Given for the due Execucon & performance of Offices & places and for the Clearing of Truth in Judiciall Causes Wee doe further by these presents Will & Require you to permitt Appeales to be made in Cases of Error from our Courts in Maryland Unto our Governor & Councill in Civill Causes Provided the Value Appealed for doe Exceed the Sume of One hundred pounds sterl And that security be first duly Given by the Appellant to Answer such Charges as shall be awarded in case the first Sentence shall be Affirmed And Whereas Wee Judge it Necessary that all our Subjects may have Liberty to Appeal
