Lib. H. D. aforesd such and so many fforts platforms Castles Cityes p. 6 Burroughs Townes & fortifications as you by the Advice aforesd shall Judge Necessary And the same or any of them to ffortifye and furnish with Ordinance Amunicon & all sorts of Armes fit and Necessary for the security and defence of our said province. And forasmuch as divers Mutinyes & disorders doe happen by persons shipped and Imployed at Sea And to the End such as shall be shipped or Imployed at Sea may be the better Governed & Ordered. Wee doe hereby Give & Grant Unto you the said ffrancis Nicholson our Captain Generall and Governor in Chiefe full power and Authority to Constitute and Appoint Captains Leivetenants Masters of ships and other Comanders And to Grant such Captains Lieutenants Masters of ships & other Comanders Comissions to Execute the Law Martiall and to Use such proceedings Authorityes punishment Correction & Execucon vpon any Offender or Offenders which shall be Mutinous Seditious dis orderly or any way vnruly either at Sea or during the time of their abode or Residence in any of the Forts Harbours or Bays of our said province or Territory as the Cause shall be found to Require according to Martial Law Provided that Nothing herein contained shall be Construed to the Enabling you or any by your Authority to hold plea or have Jurisdiction of any Offence Cause Matter or thing Coniitted or done vpon the High Sea or within any of the harbours Rivers or Creekes of our said province or Territory vnder your Governmt by any Captain Comander Lieutenant Master or other Officer Seaman Soldier or person whatsoever who shall be in Actuall service & pay in and on Board any of our ships of Warr or other vessells Acting by imediate Comission or Warrant from our Coinissioners for Executing the Office of our high Admirall of England vnder the Seale of our Admiralty or from our high Admirall of England for the time being. But that such Captain Comander Lieutenant Master Officer Seaman Soldier & other person so offending shall be left to be proceeded against & Tryed as the Merit of their offences shall Require either by Comission vnder our Great Seale of England as the Statute of the Eight & twentieth of Henry the Eight Directs or by Comission from our High Admirall according to the Act of parliament passed in the thirteenth yeare of the Reigne of the late King Charles the second of blessed Memory Intituled an Act for the Establishing Articles & Orders for the Regu lateing and better Governmt of his Majesties Navys ships of Warr and fforces by Sea and not otherwise Saving only that it shall and may be Lawfull for you vpon any such Captain or Comanders Refusing or Neglecting to Execute or vpon his Negligent or Undue Execucon of any of the written Orders he
