Ordr abt Ordered that the sifes of the Severall Counties Birds &ca make Return in Decembr next of what Birds, Wild Turkeys, Deere &Cca they have procured for his Exncy & tht they give an Accot where they are and what they must have for them, & care will be taken that they be Reed & paid for. Decernbr the 9th 1696. The Councill again Sate & were prsent as yesterday. p. 422 Benjamin Ricaud & Richard Lowder of Kent County their Peticon & ifrancia Twfford of Dorchc3tcr County hi3 Pctition, were both (being Read) Referred to the Justices of the sd Respective County Courts. The Report upon Mr Wm Hemsleys paper in the Case of the honrble Sr Thomas Laurence Baront Secretary was Read and ordered to be given to Mr Robert Gouldesborough his Mats Councillor at Law for his Opinion and Report thereon to be made, and is as followes Vizt
To his Exncy the Governr &ca Lawyet: I humbly Offer to yor Exncy my Opinion of this Opinion touching Answer that it is not direct to the Question for, Hemsleys r: The Question was whether he had not made Answer &ca vide publick vse of them by Runing the Lines of other
Ordr folio mens Land and taking pay of prsons for Coppyes 410 and this he might doe and yet say he intend them
for his private vse though he vses them in publick vses.
2: He says they are not now in nature that is noe Answer, for the Question went further (viz) if they were not in being what became of them whether burnt or how Else destroyed and that is not Answer'd and my Opinion is that he ought to make a plaine answer and such as he can give his Oath to, if by yor Exncys Reguard otherwise its plane he intends to Trifle & Evade, which is humbly Submitted to your Exncy by Yor obedient Servants George Plater Willm Dent I am of the Same Opinion R. Gouldesborough
