Lib. H. D. beyed a late Ordr of Councill Commanding the Justices of each respective County to give their directions to the Constables of the severall hundreds for the taking a New List of Taxables. The sd Bradley says tht he was not any ways knowing thereof Whitehall nor ever heard the sd Ordr Read. The sd Robert Tyler says that Mr Holiday the Cheif Justice acquainted the Court that p. 406 there was an Ordr of the Govr and Councill for taking a New list of Taxables but he Aded that the Lists had been taken already pursuant to the directions of the Law and thereupon Ordered the Clerk for to Enter an Ordr that no such ordr of their Cort should issue; Whereupon Mr Cooper did Enter such an Ordt without any Debate or Consent of the rest of the Commrs--They are Ordered to withdraw and after some con- Whitehall sultacon thereon had, being called in again, they are told that this being the first fault and considering the Originall Cause of disobeying that Ordr proceeded from the sd Mr Holliday, they were dismissed with a Caution to have a Care how they Offended in the like Nature again.
Octobt the 9th 1696. Justices of Came and appeared Mr Thomas Holiday, Mr Wil- Prince Georg's liam Barton Mr David Small & Mr John White ifour County Ex- more of the Commrs of Prince Georges County pur Cuse & par don abt an suant to summons—-They are asked the Reason why they disobeyed a late Ordr of his Exncy relating to the constables taking a New list of Taxables who for answer say tht they find they have been in an Error, for wch they are very Sorry & do humbly beg pardon; and in par ticular W Holliday does say that he understanding that he was Represented the only refractory person in causing the sd Ordr of his Exncy to be disobeyed, but does averr that all the rest of the Justices which were then upon the Bench did Assent and give their Opinion in the matter as well as himself wch he says the rest of the Justices now prsent can affirm, who doe affirm the same to be true. They are Ordered to with draw and the matter being consulted they are called in again Whitehall and are told, that having taken into consideration their Sub mission and acknowledgmt of their fault they are Excused for this time (not for that there are a great many Offenders) but with this Caution that they have a Care how they Offend in the like nature again. Mr Hutchinson the other Commrs not appearing to make his Excuse is Ordered to be dismissed from the Authority of a Justice of peace and he is hereby accordingly dismissed; but this Board not being willing to put the County to the charge of a new Commission, doe Ordr the other seaven to Officiate at pTsent by the old Commission.
