51 2 Proceedings of the Council of Maryland, 1694 97.
Lib. H. D. shall be thought requisite in that behalfe, and that the persons suspected accused be forth coming & prosecuted for the same. Whitehall October the 5th 1696.
The Councill again Sate and were prsent as before. Ordered that Mr Nicholas Lowe high Sherriffe Ordr to the . Sheriff of of Talbot County make particular inquiry into the Taibotdeath of Capt Thomas Salmon late Comandr of the
County to make inquiry Ship Habitation of London now Riding in Chop abt a decd tanck River and Strictly Examine the Seamen what person time he left the sd Ship what apparell he had on,
and what Kings, Money or other goods of Value he carryed with him; when he left the Ship and what men went with him, and to give a discription as well of the sd Mast' as Men; all which he is to make Return of unto his Exncy at the Port of Annapolis with all convenient Speed, as also get the Coroners Inquest passed upon the sd Sa!mons body or an Authentick Copy thereof to be transmitted likewise at the same time Whitehall October the 6th 1696.

Read the following Peticon Vizt To his Exncy ffrancis Nicholson Esq Capt Genll & Governor in Cheif of Maryland &cca The humble Peticon of Thomas Jones of Somerset County Gentn Humbly Sheweth, Th That your Peticonr being ffirmly bound with Capt Thomas Jones Pet. Henry Smith in a Bond of 320 ll Sterl that if a cer
abt the Ship tain Ship called the Recovery Burthen ffifty Tons, Recovery &ca which then lay under Seizure p Edward Randolph Esq should be Legally condemned yoT Petitionr should pay the sd money That the sd Ship was by Court of Admiralty condemned but not legally, being altogether agt Law; for the party concern'd and who should have Defended the Same was Never Summoned, called nor did appear, and So the p. 404 Tryall and Judgmt was ex parte: But Yor Peticonr could not bring a Writt of Error on the Same, because his Attorney William Dent refused to Serve him therein alleadging to yor Whitehall Peticonr that he was Commanded to the Service of his Maty as Sollicitot Gen” The prmises considered yor Peticonr humbly Prays yor Exncy to give Ordrs to the sdI Attorney to Serve him for his ffees in bringing of a Writt of Error on the sd Judgmt and as in Duty bound shall ever Pray.
