    Ordr of   Re- Ordered that it be Referred to Mr Attorney and Lib. H. D.

        abt Sollicitor Genll for them to Consult & Return their

    leaving their Opinion to this Board whether the Sheriffs of the

     Counties &cca Counties can legally leave their County, during their

   

           Shriveltey, & whether the posse can be raised in the

    absence of the high Sherriffe.

                September the 26th 1696.        w.

   

     The Councill again Sate and were present

   

        His Exncy ffrancis Nicholson Esq Capt Genll &cca

    Sr Thomas Laurence Baront Secry Coll: David Brown

    Coll: George Robotham     Coll: John Addison

    Coll: Nicho Greenberry   Thomas Brooke Esq.

    Coll: Charles Hutchins    James ffrisby Esq.

   

    Motions of Upon motion made by the honrble Coll: John Add

           ison & Thomas Brooks Esq that they might be

    Councill permitted to goe home, the sd Coll: Addison urging

    some pressing occasions which require his attendance there;

    and the sd Mr Brooks urging that his Servants were now in

    hand about building a Mill and could not goe forward there

    with without his prsence; Coll: Robotham also desiring the

    leave of this Board to Retire home in Ordr to the looking after

    two Severall Cargoes of Goods wch Requires his hast at this

    time—His Exncy was pleased to say that his Mats Royall

    Instructions unto him does direct that he shall not hold

    Councills to doe any business of consequence under the num

    ber of ffive of the Gentlemen of the Councill being prsent, W.

    unless in case of absolute necessity therefore acquainted them

    that they would doe well to agree among themselves about it,

    who should goe or stay, so that ffive might be left, and he

    should be willing thereto; Whereupon leave was given by Con

    sent to the three aforementioned Gentlemen to goe.
