430 Proceedings of the Council of Maryland, 1694 97.

Ordered therevpon that the Collectors & Navall Officers take care to give Notice to the severall Masters of ships within p. 341 their respective Districts for to Return an Accot to his Excell the Governr in writing what time the sd ships (now in the Countrey) will be ready to Sayle, and tht none of them be Cleared, but what shall give Bond to go down to Point Comfort in Virginia tojoyne his Mats sd hired ships there, in Ordr to go vnder their Convoy.
Produced & Read the following Petition presented by the Clerk of this Board, Vizt
To his Excellency ffrancis Nicholson Esqr Capt Genll & Governr in Chief in & over his Mats Province & Territory of Maryland; and to the honoble his Mats Councill thereof.
The humble petition of Henry Denton Clerk of the said Councill, and (by Speciall favour) appointed Clerk vpon a Com mission of Review. Henry t Sheweth tons petition That whereas vpon a List of ffees taxed (by the ffees of the honoble the Commissionrs appointed for Reviewing a Court &ca certain sentence of a Court of Delegates in a matter of controversy depending betwixt one George Lingan, Admr &ca of John Abington deceased Complainant & James Crauford Deft) and prsented for the Regulation of this honoble Board; your Excell & Honors finding no Act of As sembly of this province, directing the settlemt of any ffees proper to be taken by the Clerk of such Court, were therefore pleased to Ordr the same ffees as are (by Act of Assembly) to the honoble the Secretary prescribed; as also the like for Appeals & Writs of Error before your Excell & honors brought; but your petitionr (vpon Inquiry) conceiving that business determinable in such Superiour Courts have ffees proportionably Allowed; does therefore most humbly pray that the aforesd Ordr may be at present suspended & not become a standing Rule, untill such time as the Assembly does either settle those flees by an Act or that your Petitionr can procure an Authentick Copy of ffees (out of England) taken in like cases; your Petr being very willing (in the interim) not to medle with or demand any satis p. 342 faction for Matters of that nature vntill the same be Adjusted & setled as aforesd But as for what Judgmts vpon Appeals & Writs of Error have already passed before your Exncy & honors your Petr most humbly Craves the Costs thereon ffiled may be confirmed the Attorneys being guided in filing their sd Bills of Cost according to the constant practice & Rules for taxing Cost of like Nature, not only in the Lord Baltemores time, but
