Came Mr Thomas Collyer Navall Officer &ca who by his humble petition prayed that consideration might be had for his trouble & Expence of Seizing the aforementioned Sloops, which was in like manner also Referred. Wherevpon Mr Attorney & Sollicitor Genll Reporting that in as much as the Genll Assembly has declared by a Law that the Ten p Cent Act was never designed to extend Goods Exported for Virginia only are therefore of Opinion that respect may be had to the intent of the Law makers in this case. As to Mr Collyer, that he ought to be allowed his legall Charge & Expences. As to the proof Required &Ca the same is made apparent by the Depositions of Wm Taylard & Joshua Broadbent here produced, which were Read & Ordered to be lodged among the Councill papers. Ordered therevpon as it is hereby Ordered that the Ten p Cent for the aforementioned Goods Exported &Ca be taken off And that the Sloops exporting the same be dismissed from vnder Seizure accordingly, paying the Officer his just ffees therefore.
Commis- Ordered that what ffees are taken by the honoble sionrs & Clk of the Court the Secretarie of this province, that the same be of Review &ca ffees allowed to & taken by the Clerk of the Speciall
Order'd Court of Review inter Lingan & Crauford & no more, and that the Commissionrs be allowed the same, as the Gentlemen of the Councill are. Ordered that the sd ffees be taken for Appeals & Writs of Error brought before his Excell & Councill &Ca
May the 18th 1696.
The Councill again Sate & were present as before. Whitehall Lre from the Produced & Read a Letter by his Excell recd from Read &Ordr Capt Jackson Commander of his Mats hired ship, the inde Smirna Merchant of the 14th instant giving an Accot
of his being Ordered to Virginia together with his Mats hired Whitehall ship, the Tyger for convoying the ships now in the Countrey for England, desiring Answer when the ships here will be ready:
