      The said Petition was by Ordr indorsed as follows Vizt By Lib. H. D.

    his Exncy the Governr & Councill &ca Whitehall

   

                  March the 4th 1695/6.

   

     Ordered that the within petition be Referred to his Mats

    Attorney & Sollicitor Genll for their advice therein, and in par

    ticular to George Plater Esqr as his Mats Receiver for them to

    make their Report thereon, and then some further Ordr shall

    be given.

               They Report as follows Vizt

   

      We humbly Certify our Opinion that since the Offence

    (vpon which the present condemnation is obtained) was com

    mitted before the Reparation was made, and that the Pet' was

    Encouraged thereto by the Bond given as in the petition is

    suggested, and no new Seizure made for his Maty that then

    there is no occasion for a new Appraisemt but the former

    Value may be accepted, in case the persons that Valued the

    ship were on their Oaths, which is the Opinion of

                            Yor Excells

                               most obedient Servants

                                      Geo:  Plater

                                      Wm Dent

   

     They are Ordered to inquire whether the sd Jury were vpon

    their Oaths or no & they make return accordingly as follows,

    Vizt It is affirmed to Us by Mr Wriothesley that the

    Appraisers were vpon their Oaths, and that the same was

    sworn in Court whereof he was Clerk     Geo: Plater

                                  Wm Dent

   

   

         By his Exncy the Governr & Councill &ca

   

                  March the 5th 1695/6.

    The Ship Ordered vpon the above Report that the petitioner

    Anna Helena         . .

    being con- have Grant of the within mentioned Ship at the rate

    demncd,Or- of 301 stel. according to Appraisemt thereof already

   

    made over made, and that George Plater Esqr take care (as his Whitehall

    to Robt Mats Receiver Genll) for to secure of the pett the two

    Brown third parts thereof pursuant to the directions of the

   

    Law, and that the sd Mr Plater (if Required) give the petr in

    behalfe of his Maty a Bill of Sale for the sd ship.
