       384 Proceedings of the Council of Maryland, 1694 97.

      

      

      

      

      

      

       Lib. H. D.     gave his Bond with the condition that if the sd ship should

             happen to be condemned he would pay the same for her,

             which was accepted off, but that the said ship was then cleared

             and now a new Information exhibitted against her vpon

             Breaches supposed to be made before the sd Appraisemt

              Wherefore your Petr humbly prays that in as much as he

             has vpon the Encouragemt of the Grant aforesd bestowed a

             great deal of time & some cost in fitting the said ship a new,

             that in case she be condemned vpon this new Information, he

             may have the benefit of purchasing her on the former

             appraisemt and he will pray

       Whitehall The said Petition was by Ordr indorsed as follows, Vizt

      

                           ffebry the 29th 1695/6.

      

              Vpon the reading the within petition, it being considered

             that the Vessell will come vpon a new Tryall, therefore will

             give no further Order therein till Condemnation of the same

             pass.

                            present,

      

        His Exncy ffrancis Nicholson Esqr Capt Genll &Ca

      

                     Coll Nicholas Greenberry Thomas Brook Esqr

             The Honoble Coll Charles Hutchins

                      Coll John Addison  James ifrisby Esqr

      

             Robt Browns Came Robert Brown aforenamed, who by his

              2d petition, touching the second petition humbly set forth that the aforesd

              condemna- ship Anna Helena was (vpon a new Information

               lately brought agt her, vpon breaches supposed to be

      

      p. 292 Helena & made before the aforementioned Appraisemt) con

                   demned thereon; Wherefore he humbly prayed that

              in as much as he has vpon the Encouragement of the aforesd

             former Grant, bestowed a great dea! of time & some cost in

             fitting the said ship a new, that he might have the same Grant

             now as before, Vizt That he may have her at the said

             Appraised Value what he hath expended vpon her since,

             being done vpon Encouragemt of the sd Grant, and he

                                               Will pray.
