Lib. H. D. Burthen, that in Case the sd Ship or Vessell shall Load any of the sd Commodities at any of the English Plantations that the Same Commodities shall be by the sd Ship or Vessell brought to Some port of England or Wales or to the Town of Berwick upon Tweed and be there unloaden and put on Shore the danger of the Seas only excepted. And in like manner that noe Ship or Vessell which by Law may Trade in any of his Mats Plantations be permitted to load on board any of the sd Commodities coming from any other Port or Place untill Bond be given to the Governor in manner and to the Value aforesd That such Ship or Vessell shall Carry all the Goods laden on board to some other of his Mats Plantations or to England, Wales, or Berwick and if any such Ship or Vessell shall load or take on board any of the s” Commodities untill such Bond given to the Governr or Certifi cate Produced from the Officers of Some Custom house of England Wales or Berwick that such Bond hath been there duly given or which Contrary to the Tenor of such Bond shall Carry the sd Goods to any Port or place whatsoever then such other plantation or to England Wales or Berwick and there lay the Same on Shore every such Ship or Vessell shall be forfeited with her Guns Tackle & Apparll and you shall doe your utmost Endeavours to find out Seize and prosecute the Same accordingly. 3dly If any Ship or Vessell which by Law may Trade in any of his Mats plantacon Shall Ship and take on board any of the aforesd Commodities or Cacao & that Bond shall not be first given with one Sufficient Surety to bring the Same to England Wales or Berwick and to noe other place and there to unload & put the Same on Shore (the danger of the Seas only Ex cepted) there shall be answered and paid for so much of the sd Commodities as shall be laden and put on board such Ship or Vessell the Severall Rates & Duties mentioned in the sd Act to be leavyed Collected and paid at such places and to such Collectors and other Officers as shall be appointed to Collect Leavy and Receive the Same before the unlading thereof & Under such Penalties both to the Officers and upon the Goods as for non paymt of or defrauding his Maty of His Customes in England. p. 16 And you are to take Care that none of the aforesd Enumera ted Goods which shall be pretended for any of the Ships that have given Bond to goe to England, Wales or Berwick only and to no other place be under that Colour Stollen on Board Ships which have given Bond to goe to Some other of his Mats English Plantations or to England Wales or Berwick and so evade the Duties payable as aforesd And you are to take Notice that notwithstanding the paymt
