Attorneys Pursuant to the aboue Ordr of Reference the Sev Report abt the Ship erall\ Attorneys in Town bring in their Report, and
Ann & Mr Tenches Mr humbly Offer that the said Shipp is still left vnder
Motion Seizure, and that no condemnation can follow, but that she must be Tryed a new_Vpon Motion by
Thomas Tench Esqr made for a Speedy Tryall of the said Ship; proposed by the said Mr Tench, that if liberty may be given him to Remove the said Ship into the ifreshes to secure her from the Worm, And Madam Blakiston perswaded to take off her Replevin laid upon the said Ship he should be content to Stay till the Next Provinciall Court for a Tryall
Richard Har- Richard Harrisons Petition read, praying that his his Exncy & Execy and this Board would be pleased to appoint Counciii abt some honest Man or Men to Mannage & take care the Estate of . Mr Mr John Ab- off the Estate of John Abington dec to the Vse of ington &ca the persons it belongs to and that he may be Satis
fyed a Considrable Debt due to him from the said Estate, Sig nifying in his said Petition that the Commissary would not permitt him to Administer by reason of his Tenderness of Conscience whereby he could not qualify himself according to Law; but that James Crawford this person to whom Adminis p. I72 tracon had been committed, he did believe did designe some fraud in the Matter, therefore prayed some honest Man or Men might be appointed as aforesaid And thereupon was sent for W Commissary Genii Mr Crauford & Mr George Lingan. And Accordingly came Mr Commissary, W Lingan & Mr Crau ford by W William Dent his Attorney, the Petr being likewise prsent and after a full debate of the same had, it being made appeare by the said Harrison that the said Crauford is indebted to the said Estate, and that Mr Lingan had some Authority from the Admrs in England where the said Abington dyed; it is therefore demanded whether the said Lingan would intermeddle there with, And he Accepted thereof Accordingly; Mr Commissary thereupon Acquaints him that Letters of Administration shall be granted him (upon his giveing good security) And that Crauford should be called to Accot & the Letters of Admrcon Granted him made Void.
