should be done, Wee reposing Special Trust and confidence Lib. H. D. in your abilities prudencies & Wisdoms have thought fit to Nominate constitute and Appoint And Wee do here by these prsents Nominate Ordaine & Appoint you the Aforenamed Capt William Barton, Mr John Hawkins, Majr James Small- wood, Capt Philip Hoskins and Mr Robert Tates Justices and Comissionrs for the hearing and determining as well the afore mentioned difference now depending as all other differences or Law suites which are or may any wise happen betwixt the said parties during the continuance of this our Commission And for that End and purpose you are hereby Empowered to Call before you Twelve good and Lawfull Men of the Vicinity by whom the truth of the Matters may the better be known as also to Sumons what Evidences either party shall Require by you to be sworn to Say the truth in the premises, And upon the Verdict of the Jury brought in, your finall doome Sentence and determination shall Make as to Law & Justice appertain eth, hereby appointing you the aforesaid Capt William Barton, p. 154 Mr John Hawkins, Majr James Smallwood, Capt Philip Hos kins and Mr Robt Tates to meet and Sit at Charles Town in Charles County the day of March instant or any three or more of you Whereof you the said Capt William Barton, Mr John Hawkins & Mr James Smallwood to be always one for the fully hearing and determining the Above Mentioned prmises hereby likewise Empowering you after Judgmt Given to take Moderate Cost and to Adjourne from day to day Untill the business afd. by you be fully determined And to the End you may keep a faire Record of All your Proceedings herein Wee do Nominate and Appoint Cleborn Lomax to be your Clerke he having first taken the Oathes appointed by Act of Parliamt to be taken instead of the Oathes of Allegiance and Supremacy as also the Test, a faire Coppy of which proceed ings you are to Transrnitt Unto Us Attested under the hand of your said Clk. in our high Court of Chancery among the Records of the Office of our said Court to Remain and be kept, Given at Ann Arrundell Town in Ann Arrundell County the second day of March in the seaventh year of our Reigne &ca Annoq Domi: 1694 ffr: Nicholson
