       Lib. H. D.     therwith it being a Judiciall Office Ordered therupon that Mr

             Kenelem Cheseldyn the Petitioner continue to Act in the S'd

                    Office as formerly Until further Order or Untill

              their Majties pleasure be knowne therein But

             continued whereas Complaints have been made that some of

             Comissary the Deputy Comissarys have been guilty of extort-

      

       Whitehall ing Unjust ffees from the People the said Mr Cheseldyn there

             fore is hereby Required to take care that his Deputies

             conforme themselvs in takeing of ffees According to Law his

             Excency being well Satisfyed as to his part

      

      

                     October the 17th 1694.

      

               Produced again and Read the Vote of the House of Bur

             gesses relating to Wm Burley and George Mason prisoners

             now under the Sentence of Death,

               This Board doe Agree with the Vote of the sd House, and

             all the Lawyers in Town appearing at the Board to Advize

             whether the Law will admit of Bayle in Such Case, and

             whether an Act for the sd Purpose might be proper to pass;

             To which they are of Opinion that they may be set to Bayle

             upon Soe Speciall a Case as this and that the Same will be

             best to be Done without an Act Then it is Demanded by his

             Exncy what Bayle is most proper to be taken, to which was

             answered that the best way that Can be taken is that they

             bring two persons who will Enter into Recognizance body for

             Body that the sd Prisonrs shall be forth Coming when Called.

               Ordered that the sd Prisonrs be set to Bayle they bringing

             two persons to morrow morning before this Board and House

             of Burgesses that will enter into Recognizance body for Body

             for the sd Mason and Burley's appearance when Called.

              His Execncy the Governr and all the Members of their Majties

               Hononble Councill except Mr James ffrisby.

             Navall Offi- Ordered that there be three Navall Officers

              Appointed in the uper part of Chessiopeak Bay, Vizt

             the Bay in Caecill County at the head of the Bay Collonell

             Whitehall   . .

                    Willm Pierce at Oxford Towne in Talbote County

             Mr Thomas Smithson and at An-Arundell Towne in An Arun

             dell County Capt Richard Hill. Came Colln William Pierce

             and Capt Richard Hill two Navall Officers as above Appointd
