Whereas upon the Death of Lyonel Copley Esqr late Gov-
ernor of Maryland, Sr Edmond Andros Knight Governor of
Virginia in their Maties names did Assume and take upon
him the Government and Chief Comand of this Province by
Virtue of a Comission from their Maties bearing Date the
third day of March Anno Domini one Thousand six hundred
and ninety one in the fourth year of their Maties reigne under
their Signett and Signe Manuall, wherein and whereby their
Majesties were pleased by those presents to Constitute &
appoint the said Sr Edmond Andros upon the Death of Capt
Francis Nicholson and in the Absence of the said Lyonel
Copley (and not otherwise) to be Comander in Chief in and
over this Province and by Virtue thereof the said Sr Edmund
Andros in theire Matys name by his Proclamation bearing
Date the Twenty fifth day of September one Thousand six

hundred ninety and three in the fifth year of their Maties

reigne reciteing That whereas by the Death of the said
Lyonell Copley theire Maties late Capt General and Governor
in Chiefe in and over this theire Province of Maryland and the
Absence of Capt Francis Nicholson their Maties Lievt Gov-
ernor of the same the Chief Comand and Government of the
said Province was Comitted to the Charge and Conduct of
him the said Sr Edmond Andros Knt their Maties Lievt and
Governor Generall of their Colony and Dominion of Virginia he
the said Sr Edmund Andross thereby did Proclaime and
Declare That all Officers Civil! and Military should hould and
Continue their Severall and respective places and Offices by
the same as in and by the said Comission and Proclamation
remaining upon Record in the Councill Records more att
large may Appear and because upon reading and inquireing

into a Certein Comission of their Maties bearing Date the
Twenty fourth day of February Ano Domini one Thousand
six hundred Ninety and one. To Captaine Francis Nicholson
Appointing & Constituting the said Francis Nicholson Lievt
Governor of and in this Province and upon the Death of the
said Lyonell Copley to Exercise and Execute the severall
powers & Authoritys in the said Commission to the said Gov-
ernor Copley, it appears to us That their Maties had made
Express provision that the said Lievt Governor Nicholson
upon the Death of the said Lyonel Copley Esqr should Suc-
ceed to the Chiefe Comand in this Province and if not present
upon the place att the Death of the said Lyonell Copley That
the Councill should take upon them the Government of the
Province whereof the first in Councill to preside neither doth
the said Comission to the said Sr Edmund Andros Sufficiently
Authorize the sd Sr Edmund Andros to take upon him the Gov-
ernment aforesd but upon the Death of the said Francis
