said hogsheads as aforesaid att each respective house burn
in the Bulge of each respective hogshead by him sett up as
aforesaid with a Brand Iron the Two first Letters of his name
and every hogshead by him so branded to weigh and the true
weight thereof with Marking irons to cutt into the Bulge afd
on penalty and forfeiture of the loss of his Labour for every
Casque or Hogshead not Branded as aforesaid to the Imployer
of such Cooper as also the sume of one hundred pounds of
Tobbacco for every hogshead by him falsly weighed or marked
as aforesaid one halfe thereof to our Sovereigne Lord & Lady
the King and Queen their heires and Successors for the use
aforesd and the other halfe to him or them that shall sue for
the same to be recovered as aforesaid Provided That this Act
nor any thing therein Conteined shall be Construed or taken
to prejudice any Cooper or Coopers or other person or persons
undertaking to sett up Tobbacco Hogsheads as aforesaid for
any Error or Mistake in the Weight of each respective Hogs-
head by him so weighed and Marked as afd not Exceeding
five pounds Weight in the hogshead and that all and every
person and persons whatsoever that shall undertake to make
his or their own Cask shall and are hereby obliged to brand
weigh and Mark every respective hogshead by him so made
under the same Penalty and forfeiture as is before mentioned

and Expressed And be it further Enacted by the Authority
aforesaid by and with the Advice & Consent aforesaid That
every Master or other owner of any Servants or negros
Coopers or that shall Imploy any Servant or negro to sett up
his her or their Cask or Tobbacco hogsheads such Master or
other owner shall be obliged to fall Saw rive hew and sett up
such their Tobbacco hogsheads within the Severall and respec-
tive times as by this Law is before limitted and appointed, and
them when finisht to brand Mark & Weigh under the same
Penaltys and forfeitures as is before Provided against Coopers
and other persons undertaking to sett up Tobbacco hogsheads
as aforesaid in Consideration of all which the Receiver of any
hogshead of Tobbacco shall pay and allow to the Owner or
Owners thereof for each hogshead Received the sume of
fourty pounds of Tobbacco deducting out of the Gross weight
the true weight of each hogshead Marked on the Bulge afore-
said and no more any other Act to the Contrary notwith-
standing.

An Act for Confirmation of all proceedings Juditiall Military
and Civill from the death of his Excellency Lyonel Copley
Esqr their Maties late Governor and Capt Generall of Mary-
land &c unto the Arrivall of his present Excellcy Francis
Nicholson Esqr the present Governor thereof.
