In the upper house of Assembly

Nathan Barton of Stafford County in the Collony of Vir-
ginia gentl aged four and fourty yeares upon Oath taken on
the holy Evangelists saith
That about a fortnight after Capt ffendall was taken or
thereabouts to his best Remembrance One Edward Holmes
then a Souldier in Garrison in the said Collony of Virginia
under the Command of Capt Cooper haveing little before
been at Major Gilsons house, told this Deponent that Samuel
ffendall had been at Major Gilsons house, and his chiefe busi-
ness was for Assistance to gett his Brother out of prison, and
was intended to goe to Coll Spencers, but was rebuked by
some of the Company then at said Gilsons house telling him
that it was a foolish vain thing for him soe to doe, for he
would certainly receive rather a check from Coll Spencer then
any Assistance, whereupon the said ffendall desisted from his
Designe, and returned for Maryland.
These or words to the same effect this Deponent heard
from the sd Holmes at the garrison aforesaid. And further
saith not.
