Secrys of this Province to conferr on him the next Clks: place
that fell within this Province, They accordingly did upon the

death of Mr Darcey late Clk of the said County place him the
said Butler in the said office of Clk of Calvert County Court.
That his Lspp the Rt honble the Lord Propry not knowing of any
such provision made for him the sd Butler, hath since sent
him in a Commission for the Clks place of Charles County
That although the said Butler cannot but with all humility
heartily acknowledge his Lapps Grace and favour towards him
and being soe mindfull and carefull of him, yett in regard
that he haveing provided and suited himself to Officiate in the
said County of Calvert, haveing made some begining and
fitted himself for a progress therein He humbly prayes that he

may be continued in the sd Office in Calvert County Court,

and that his Lsps: Comon for Charles County as to him may be
suspended, and conferred upon some other, especially con-
sidering that his Lspp was altogether unknowing and unadvised
of his the said Butlers Settlement aforesaid, as by his Ldsps
Letter produced and read may appeare (viz)

I reed: very lately a Letter from you, wherein you in forme
me of your being at Coll Darnalls house, where you were
civilly treated; but that you had not obteined a Comon for any
Clks place, nor had any prospect of haveing One, which I was
troubled to understand, therefore that you may loose noe
more of your time, I will now write to my Secry: to settle you
Clk of the Court in Charles County, which I suppose may be
of some advantage to you; and when I returne to Maryland,
I will take such further care of yu as shall fully satisfie you,
that I have much kindness for you, being sensible you will soe
behave your self as that yu will at all times deserve it from

As to all which the honble the Secrys pray the advice of this
board whither they may with safety sett aside a positive Comon
from his Lsp to the sd Butler for the Clks place of Charles
County and contrarily thereunto continue him in Calvert
County as he desires.
Whereupon It was the opinion of the Major part that his
Lspp was not knowing of the provision before made for the
