were of opinion and did conceive that (the Surveyr of that
County liveing in Cal/ert County and without the precincts of
Charles County aforesaid) they had noe power to command
his attendance there upon all occasions by reason their warrant
or summons was of noe effect without the limitts of their
County, by wch meanes the proceeding to lay out the Townes
there marking lotting and stakeing the same according to the

tenor of the sd Act had been hitherto obstructed and soe was
like still to continue unless some effectuall care taken to
remedy the same

Deputy Surveyr to obey the Comrs summons in what County
soever held.

It was thereupon the opinion of this board that the Com"
nominated in the act, for managemt of that affaire had power
to summons the Deputy Surveyr of their County to attend
them upon all occasions lett him be in what other County
soever within this Province, and that such summons or war-
rant was good and effectuall and ought to be observed duely
by the said Surveyr at his perill according to the following
ordr of Councill in this behalf passed (viz:)

ordr Councill to summons together the Comrs for Townes in
Cha: Co: to lay out Townes &c: and to summons the Surveyr

Maryld ss: By the Councill
Ordered that Robert Doyne gentl high Sher. of Charles
County forthwith give notice to and summons together the
Comissrs appointed and nominated by the Act for advancemt
of trade to lay out the severall Townes and Ports of trade in
the said Act mentioned for the said County: and give them to
understand that It is the opinion and ordr of this board that
they give speciall notice to Capt Ninion Beal Depty Surveyr
for the County aforesaid, immediately to goe & lay out lott,
mark and stake the severall Ports and places of Trade in the
sd Act mentioned and appointed within the sd County and
which are not already laid out, lotted, marked & staked as
aforesaid: hereby strictly chargeing and Commanding the sd
Ninion Beale duely to observe, obey, and execute such sum-
mons, ordrs and directions, therein, as the sd Comrs pursuant
hereunto shall give him: Whereof lett there be noe faile;
Dated at the Councill Chamber at
the City of St Maries the Sixth day of October in the
Tenth yeare of the Dominion of the Rt honble Charles
&c: Annoq Dmi. 1685:
