Ordered that the said Lynch come and answer the prem-
ises
He appeares and the complaint of, the petr Read unto him
in presence of the Complainant
To wch the said Lynch (being thereunto required) made an-
swer and alledged that he had severall good reasons to urge
why he cannot discharge the Petr such as the deteining of his
goods or Imbezelling them, disobedience and breach of ordrs
which he is able to make appeare in time and place conven-
ient; and moreover that the said Estes hath already sought
his redress by other waies (as makeing protest against him)
if he hath been any waies injured And therefore he refuses
to give any further satisfaction to the claime of the pef
Which this board, having noe other meanes but arguments
and pswasion to induce him to, think not fitt to concerne
themselves further therewith, and therefore dismiss the same.
Memdu Came Capt John Estes Commandr of the Shipp
Providence of Deale who being sworne and Examined Saith.
That he gave unto Mr Nehemiah Blackiston for a gratuity the
summe of Tenn pounds sterling to lett him have his liberty of
goeing away with his shipp from Virginia wthout further trou-
ble or prosecution, he haveing been seized by Captn Alien,
and carried thither for his tryall: ffor which the said Blackiston
as the Kings Collector there did accept off his the said Estes
bond to stand tryall in England, and the abovesd summe of
Tenn pounds sterl for a gratuity for the same, ffor which the
sd Estes passed his bills of exchange to reimburse Capt Thomas
Smith who paid for him the money
The honble Coll Digges acquaints the board that he heard
Capt Thomas Smith say that he paid Mr Blackiston Tenn
pounds sterl for Capt Estes for some business in Virginia, but
for what, the said Smith refused to tell.
