Ketch then lay for the apprehending and takeing into safe
custody the body of the murderer, to the end he might be pro-
ceeded against according to Law, which warrant this Depo-
nent did see, and very well knoweth was sent out. And
further at prsent saith not

Robert Carvile of St Maries County in the Province of
Maryland aged ffourty Eight yeares & upwards sworne and
examined deposeth and saith as followeth That upon Sunday
the second day of November instant this Deponent was
requested by the honble Coll Henry Darnall & Major Nicholas
Sewall to goe along with them together with Mr John Llewel-
lin on board of a Ketch in Pottuxen River which was called
his Majties Ketch; and whereof Capt. Allen was then Com-
mandr and on board of wch Ketch was kept prisoner in Irons
Coll George Talbott for the murder of Mr Christopher Rousby
as was then reported, that accordingly this Deponent did
waite upon their Honors Coll Darnall and Majr Sewall on
board, that being come aboard Coll Darnall and Majr Sewall
were Invited into the Capts Cabbin, and not long after this
Deponent was also invited into the same Cabbin That after
some relation made by Capt Allen touching the manner of the
ffact committed by Coll Talbott on the body of Mr Christopher
Rousby by a stabb with a skeene or dagger then produced,
this Deponent heard Coll Darnall in the p'sence of Mr Sewall
and others in the Cabbin demand of the sd Capt Allen the
said Coll Talbott to be delivered under a good or safe guard
of Capt Allens ashore to the Governmt of the Province, to be
secured and tryed according to Law; and this Coll Darnall
demanded of Capt Allen in the name of the Rt honb1' the Lord
Propry but Capt Allen absolutely refused to deliver him the
said Coll Talbott upon any command in the name of the Lord
Propry but if they would demand the prisoner in his Maj'ties
name our Soveraigne Lord the King, he would deliver him,

To which it was replyed by Coll Darnall, or Majr Sewall or
both, that they could not doe it in his Majties name, though what
they did in his Ldsps name, was by vertue of his Maj'ies authority
by his grant, which was then produced in print, and tendred
to the Capt to read, but he sayd he had scene read or knew
the same already Capt Allen say'd he would carry him to Vir-
ginia, and there receive ordrs from my Lord Effingham his
Chiefe Master in these parts, as he sayed, or to that effect was
the discourse amongst them. Then this Deponent doth also
remember there was some discourse urged by Capt Allen
