330 Proceedings of the Council of Maryland, 1681-85/6.

, said he knew the Charter well enough, or words to that effect:
That from thence they fell to discouse of the Commandrs
power, and he produced his Commission and Instructions,
some of which the Deponent thinkes he read; but they alledg-
ing that he ought to have applyed himself to the Governmt upon
his arrivallinto the Province, and civilly have made knowne his
power, he replyed he had nothing to doe with the Governmt his
business was with the Kings Collector and my Lord Effing-
ham his Chiefe Master in these parts. The greate power and
priviledge granted by his Majtie to his Lsp in his Charter of
Maryland was then urged to him, and that thereby all persons
civill and military were required to be obedient to his Majties
Commands therein; The Commandr then replyed he knew it,
and sayd that if any occasion offered he would be ready and
willing to aid and assist his Lsp: and his Governmt but to
deliver up the Prisoner upon any demand made in the Lord
Proprys name he could not, but in the Kings name he would:
The discourse being ended, and the said Coll Darnall and
Majr Sewall takeing their leaves, The Command' ordred his
pinnace to waite on them ashoare; soe goeing over the sides
The said Coll Darnall once more in the name of the Rt honble
the Lord Propry demanded the delivery up of the prisoner to
the Governmt but he refused again soe to doe, and thereupon
they putt off; but after the civility of the shipp shewed them,
and they gotten some distance off the Ketch, The Com-
mandr ordred the pinnace back aboard, and accordingly
wee were carried aboard, where the Commandr and the said
Coll Darnall and Majr Sewall, went into the Cabin, and had
some discourse, which was (as this Depont was told, and
understood by the sequell) that he the said Comandr was
informed that they had layd waite with twenty men ashoare to
surprize his men, To which the sd Allen added, (in the heare-
ing of this Deponent goeing downe into the Cabbin) by God
gentlemen if you offer any such thing, expect nothing but fire
and sword from me or words to that effect, but they haveing
satisfied him with the falsity of the Report, he civilly dismissed

them, and ordered his Pinnance again to waite on them
ashoare

The Deponent also remembreth and further saith that Coll
Darnall (when they were aboard the Ketch) did acquaint the
Command" Capt Allen, that he the said Coll Darnall, and Majr
Sewall had issued out their warrants to the Sheriff of the
