At A Council held at the City of Saint Marys the 31st day

of March Anno Domini 1683

The Right Honourable the Lord Proprietary

By John Richardson A Petition viz.

To the Right Honourable the Lord Proprietary and his
Honble Council
The humble petition of John Richardson of Durham County
Humbly Sheweth
That your Petitioner and one Francis Whitwell of the same
County (not knowing but that the said Durham County was
within the Government of New York) obtained Warrants and
had surveyed and laid out for them in the said County under
the Government of New York aforesaid Two thousand Acres
of Land called Mill Range and obtained A Grant for the same
from the Governor of New York aforesaid, that the said Whit-
well will not believe that the said County is within this your
Lordships Province and therefore hath not nor will not sue to
your Lordship for A Grant for the said Two Thousand Acres
of Land but doth refuse to Join with your Petitioner therein,
alledging that he is secure in his Title from New York; that
your Petitioner being assured that the same County is within
this Province, and desirous to enjoy what Land he hath there
under your Lordship doth humbly pray
That a Speciall Warrant may be Granted him to have
Resurveyed and laid out in his own name the said two Thou-
sand Acres of land and that upon the Return of the Certifi-
cate of Resurvey thereof your Petitioner making good Rights
for the same within twelve months after he may have A Grant
for the same to him and his Heirs for ever.
And your Petitioner as in duty Bound shall ever pray.

Ordered that Speciall Warrant issue to the Surveyor Gen-
eral of this provs or his Deputy to Resurvey and lay out for
and in the name of the Petitioner the said Tract of Two Thou-
sand Acres in the Petition mentioned according to the true
Antient Metes and Bounds thereof giving notice thereof to
the said Francis Whitwell of such his Warrant before he
Execute the same Certificate thereof to be returned to his
Lordship and Council with all Convenient speed for further
Consideration & answer to the Petition.
